Terms & Conditions

Effective Date: June 13, 2024

These Terms and Conditions (“Terms”) govern your use of this website and any purchase made through Mariner Containers (“Company,” “we,” “our,” or “us”). By accessing the website, requesting a quote, placing an order, or purchasing a product, you agree to these Terms. If you do not agree, please do not use this website or place an order.

1. Company Details

Company Name: Mariner Containers

Contact Email: info@marinercontainers.com

U.S. operations handle order fulfillment, shipping coordination, and customer service. International deliveries are arranged on a case-by-case basis and may involve additional documentation and customs requirements.

2. Definitions
  • “Customer/You” refers to the person or entity placing an order.
  • “Products” means shipping containers and cabins listed on our website.
  • “Order” means a purchase request submitted through the website, invoice, or approved quote.
  • “Condition Category” refers to container condition classifications described on our Conditions page and product listings.
  • “Dispatch” means the point at which a carrier has been scheduled and the container is released for delivery.
3. Eligibility and Accuracy of Information

By placing an order, you confirm that:

  • You are at least 18 years old;
  • You have authority to purchase on behalf of yourself or your organization;
  • You will provide accurate billing, delivery, and contact information.

Orders may be declined or paused if information is incomplete, inconsistent, or if delivery appears unsafe or infeasible.

4. Product Information and Condition Expectations

Shipping containers are industrial assets. Product listings describe container types, features, and condition categories accurately to the best of our knowledge.

You acknowledge that:

  • Used containers may show cosmetic wear, dents, surface rust, paint wear, or markings consistent with prior service;
  • Minor variation in appearance is normal for industrial equipment;
  • Functional suitability is determined based on the stated condition category.
5. Pricing, Quotes, and Availability

Product prices reflect the container unit price unless explicitly stated otherwise. Prices may change due to inventory, regional logistics, supplier costs, or market fluctuations.

Shipping and Additional Charges: Delivery costs are not included unless explicitly stated and will be confirmed before dispatch.

Availability: Orders are only secured after confirmation and full payment (or approved deposit arrangement).

6. Orders, Invoicing, and Payment

An order is confirmed when:

  • You receive written confirmation (invoice or order acknowledgment);
  • Payment has been received and verified.

Full payment is required before dispatch unless a deposit arrangement is approved. Accepted payment methods are described in our Payment Policy.

7. Shipping, Delivery, and Site Requirements

Delivery is available across the United States (subject to carrier and access availability) and internationally by arrangement.

Delivery timelines are estimates and may be affected by weather, traffic, carrier schedules, and site accessibility. Customers are responsible for ensuring delivery sites are accessible, including:

  • Clear access for delivery vehicles;
  • Adequate turning and placement space;
  • Level, stable ground for container placement;
  • No overhead obstructions (power lines, trees, or structures).

Failure to provide suitable access may result in rescheduling fees, redelivery charges, or other carrier costs.

Full details are outlined in our Shipping Policy.

8. Inspection and Acceptance

Customers must inspect containers promptly after delivery. Issues such as:

  • Incorrect unit, type, or size delivered;
  • Incorrect condition category;
  • Major functional defects;
  • Transport damage;

must be reported within 7 calendar days of delivery. Delayed reports may limit or void return/refund eligibility.

9. Returns, Refunds, and Cancellations

Returns and refunds are strictly governed by our Refund and Returns Policy. Cosmetic wear consistent with the stated condition is not a defect.

Cancellations may be possible before dispatch scheduling. Once planning or carrier coordination begins, administrative or carrier costs may apply.

10. Sales Tax and Exemptions

Applicable taxes are determined based on delivery location. Customers claiming tax exemption must provide valid documentation before payment. See our Sales Tax Policy for full details.

11. Title, Risk of Loss, and Use

Unless otherwise required by law:

  • Title and risk of loss transfer to the customer upon delivery and acceptance;
  • Customers are responsible for safe, compliant use of containers, including permitting, zoning, and site requirements;
  • Improper handling or modification after delivery may void certain guarantees.
12. No Misleading Guarantees

Containers are sold as used or new based on the condition category. Statements on the website must be interpreted within industrial standards.

13. Limitation of Liability

To the fullest extent permitted by law, Mariner Containers is not liable for:

  • Indirect, incidental, or consequential damages;
  • Delays outside our control (carrier disruptions, weather, site inaccessibility, force majeure);
  • Misuse, modification, or improper placement after delivery.

Where liability cannot be excluded, total liability is limited to the amount paid for the relevant product(s), unless otherwise required by law.

14. Intellectual Property

Website content, branding, text, and original materials are protected. Unauthorized reproduction for commercial purposes is prohibited. Third-party trademarks remain the property of their respective owners.

15. Changes to These Terms

We may update these Terms periodically. Continued use of the website after posting constitutes acceptance of the updated Terms. Always refer to the effective date at the top of this page.

16. Governing Law and Dispute Handling

For U.S. deliveries, these Terms are governed by applicable U.S. consumer and commercial law. For international transactions, local rules may apply. Customers agree to contact us first to resolve disputes before external claims.
