By accessing this website, requesting a quote, placing an order, or completing a purchase, you agree to these Terms.

By placing an order, you confirm that you:

  • Will provide accurate billing, delivery, and contact information.

We reserve the right to decline or pause an order if information is incomplete, inconsistent, or delivery appears unsafe or impractical.

Shipping containers are industrial assets. Product listings describe container type, features, and condition as accurately as possible.

You acknowledge that:

  • Minor cosmetic wear may exist depending on the stated condition;
  • Used containers may have dents, rust, markings, or paint wear consistent with prior use;
  • Variation in appearance is normal for industrial equipment.

5. Pricing, Quotes, and Availability

Pricing: Product prices listed on the website represent the container or cabin price and may change due to inventory, regional logistics, supplier, or market factors.

Shipping & Additional Charges: Unless explicitly stated, prices exclude delivery, which is confirmed prior to dispatch.

Availability: Products are only secured after written order confirmation and receipt of payment (see Section 6).

6. Orders, Payment, and Confirmation

Order Confirmation: An order is confirmed when you receive written confirmation (invoice or email) and payment is verified.

Payment: Full payment is required before dispatch unless a written deposit arrangement has been approved. Accepted methods and procedures are detailed in the Payment Policy.

7. Shipping, Delivery, and Site Responsibility

Delivery Area: Across the U.S. (subject to carrier availability) and internationally by arrangement.

Delivery Timelines: Estimated and not guaranteed; depend on scheduling, location, and carrier availability. Refer to the Shipping Policy.

Site Responsibility: Customers must ensure delivery sites are accessible, level, and free of obstructions. Additional fees may apply for inaccessible sites.

8. Inspection and Acceptance

Containers must be inspected promptly after delivery. Any issues with incorrect type, size, condition, or transport damage should be reported within 7 calendar days to be eligible for corrective action or return. Refer to the Return & Refund Policy for detailed procedures.

9. Returns, Cancellations, and Refunds

Handled according to the Return & Refund Policy. Cosmetic wear consistent with the condition category is not considered a defect. Cancellations prior to dispatch may incur administrative or carrier fees.

10. Sales Tax and Exemptions

Applicable sales tax is based on delivery location and state regulations. Tax-exempt customers must provide approved documentation before payment. See the Sales Tax Policy for details.

11. Title and Risk of Loss

Title and risk of loss generally transfer to the customer upon delivery at the agreed location. Customers are responsible for safe and compliant use, including modifications, permits, zoning, and local regulations.

12. No Misleading Guarantees

Shipping containers are not presented as new unless explicitly stated (e.g., “New – One Trip”). All product descriptions should be understood in the context of industrial container standards and the applicable condition category.

13. Limitation of Liability

To the fullest extent permitted by law, Mariner Containers is not liable for:

  • Indirect, incidental, or consequential damages;
  • Losses caused by delays outside our control (carrier issues, weather, force majeure);
  • Damage from misuse, modification, or improper placement after delivery.

Where liability cannot be excluded, total liability is limited to the purchase price paid for the relevant product(s), unless otherwise required by law.

14. Intellectual Property

All website content, branding, text, and materials are protected and may not be reproduced for commercial purposes without permission. Third-party trademarks remain property of their respective owners.

15. Governing Law and Dispute Resolution

For U.S. deliveries, these Terms are interpreted in accordance with U.S. consumer and commercial rules. For international orders, local regulations may apply. Customers agree to contact us first to resolve concerns before external disputes.
